health care act. while the senate will not debate or vote on the appeal, the house insisted on making its election year point. nbc's steve handelsman has more. >> the bill is passed. >> reporter: it's a vote on obama health care that will not change the law. >> we all know this bill will pass the house and die in the senate. >> reporter: but republicans want to show their resolve to kill what they call obama care. >> this bill's making our economy worse and driving up the cost of health care and making it harder for small businesses to hire new workers. >> reporter: democrats warned against repeat. >> it closes a door to wellness that's now just being opened to over 30 million americans. >> reporter: house republican leaders have held just 30 votes to help kill the obama law it's time for the republicans to end their relentless session of taking away health care benefits for millions of americans. >> reporter: but like congress, americans are still divided. >> just because it's been ruled

constitutional doesn't mean all aspects aren't great and we shouldn't discuss them. >> reporter: mitt romney held up his end and did it at the ncaap and got booed. >> i'm going to eliminate every program i can find and that includes obama care, and i'm going to work to reform to save -- >> i probably would have not used the term in that crowd obama care because he personalized it and all of a sudden it seemed more like he was talking about the president. >> reporter: but romney figures keeping health care as the top issue will help him in november and this why republicans staged another vote. i'm steve handelsman, nbc news, capitol hill. well, the inexternal report on what penn state did or did not do during the jerry sandusky years is set for release this morning. findings could be explosive if what the piemted investigators

said back in november was confirmed. that, quote, failures by the school may have enabled the misconduct to occur in it not being reported. chris clackum has the details. >> reporter: about three weeks after jerry sandusky was convicted of sexually abusing boys, the university braced for more bombshells. results will be released online on thursday morning. while nothing is official much of it is expected to be critical of the late joe paterno and what he did or did not do when told by assistant mike mcqueary back in 2001 that he had just seen sandusky showering with a boy in a team locker room. paterno's family is already on the defensive with a statement that says in part joe paterno did not act in any way to

prevent a proper gas of jerry sandusky. the school is also bracing to see how the report helps or hurts the slew of lawsuits expected from sandusky's victim ims. illinois congressman jesse jackson jr. is being treated for what his doctors describe as a mood disorder. a statement from jackson's office says he's getting what's called intensive medical care at a residential treatment facility. the state says he's expected to make a full recovery and denied jackson is being treated for alcoholism. however, a family friend told nbc news the problem is actually severe clinical depression and an alcohol problem. jackson has been on a leave of absence from congress since june 10th. and now here's a look at some other stories making news early today in america. in houston a thief broke into a restaurant and grabbed a large safe using chair to wheel it out, but he made off with more than cash.

the bandit swiped the secret recipe for an award-winning burger. in mississippi an extreme case of mother knows best. she and her son went to a convenience store. he pretended to be buying chip bus then he pull add gun on the clerk but when mom saw what was going on, she grabbed the weapon and ordered her son to leave. the gun turned out to be fake. the son is now in a very real jail. and finally in texas, follow that scooter. police are fishing for the man in this video who stole seafood from a walmart using his motorized chair to make his escape. he lifted $200 worth of lobster tails. he loaded them right into the basket, road out to the store and stuffed the crustaceans and

drove off. somebody got a license from the vehicle but not a look at the car. and now for a look at your national and regional weather, here's nbc meteorologist bill karins with the weather channel forecast. we can't script these things. >> no butter? >> he went else where for the butter. well, good morning, everyone. yesterday an amazingly hot temperature was recorded in dealt valley national park in california. it was 128 degrees there at the floor of death valley for the hottest locations on the entire planet. they got as high as 134. 128 is still just amazing. it was 114 in vegas. so all the encredible heat that was over the entire heat last week is still over utah. so we had rain yesterday, much needed rain, welcomed rain. louisiana, mississippi, through georgia, also through through the carolinas. i think we're going to get another round of thunderstorms today and tomorrow. but we need this rain to get

government. a federal judge in mississippi has decided to block that state's troeshls new abortion law. it could have effectively shut down the state's only abortion clinic because its doctors do not have admitting privileges at a local hospital as required in the law. the september 11th terrorist attack is the most memorable moment shared by american television viewers in the last 50 years. according to a new poll, the 911 attack was almost twice as impactful as this second ranked moment, hurricane katrina in 2005. and the streets of new york city filled with people turned out to watch the manhattan henge. it's quite a sun. it's when the western sun perfectly aligned with the grid of streets. it is such a spectacular view, even us jade new yorkers stay for a photo.

here's a look at how wall street will kick off the day. the dow opened at 12604 after losing 489. the s&p was down a fraction. nasdaq down 14. taking a look at trading overseas the nikkei safrmg 130 points while in hong kong the hang seng plummeted 394. stocks fell once again wednesday minutes after the feds' june meeting hoped for another round of stimulus from the central bank. most policy makers weren't ready to make a move. still some are holding out hope, stressing the meeting held prior to the most recent down data. market reaction was immediate. the euro hit a new two-year low against the dollar. gold lost earlier gains closing nearly flat. the fed minutes combined with a big sale sending yields to near record lows. oil seesawed, falling after the fed minutes also showed lower

groikt expectations but oil later zoomed up on lower u.s. petroleum inventories and expectations for north sea oil production to fall. all that made aisle stocks big winners led by chevron and exxonmobil. internet service groupon tumbled to a new low on recent data showing steep drops in online visits. now below $8, groupon went public in november for $20 a share. after hours, struggling supermarket on rate super pl valu considering selling the company. >> calloway consider cuts its work force. and the cdc wants us to know we have a sense of humor. following their guide for surviving a zombie apocalypse they now offer a wedding day survival guide.
